Built in Solutions - Terms & Conditions

 

1. Supplier

The supplier is Built-In Solutions, Mill Farm Barns, Lower road, Long Hanborough, Oxon OX29 8LW. As a user of our service you acknowledge any transactions you make are subject to our terms and conditions below. We reserve the right to change and amend these terms and conditions. Any changes we make will be deemed to have come into effect on the date that they have been posted on our website. You are responsible for reading the terms and conditions. When you place an order with Built-In solutions you will be deemed to have read, understood and accepted these terms and conditions. Our acceptance of your order brings into existence a legally binding contract between us.

2. Payments

All goods remain the property of Built-In Solutions until payment is received in full. We must receive a deposit of 50% of the price for the goods that you order before your order can be accepted,  the remaining 50% on completion (by completion we mean the your furniture is ready to use, or is being used for its intended purpose, bar any snagging issues). Payment will be requested on completion, or an invoice issued. Failure to provide the remaining balance with in one calendar week of our invoice for domestic clients, and within 28 days for commercial clients will be subject to £200.00 +VAT late payment fee and a monthly interest charge of the current Bank of England Base Rate + 5% for Domestic clients or in accordance with the Late Payment of Commercial Debts (Interest) Act 1998 for Commercial clients. Built-In Solutions will also charge and be entitled to claim any cost or charges involved in recovering overdue accounts. If extenuating circumstances present themselves and you have to cancel the work we will gladly refund any of your deposit which has not been spent on materials or allocated for labour, or for providing drawings, subject to a minimum 20% +VAT fee. 

3. Delivery

We may at the time of order provide you with an indicative lead time. However since each order is made to the customers specification and we may have to order materials for that specific order we cannot guarantee delivery lead times. Accordingly any delivery lead time quoted will be indicative only and time will not be of the essence for this contract. In particular the default 30 days for contract performance under the United Kingdoms Distance Selling Regulations shall not apply. We will not be liable for any loss or damage suffered by you through delay in delivery. We make every effort to deliver the goods within the expected timetable, however delays are sometimes inevitable due to unforeseen circumstances. Built-In Solutions accepts no liability in respect of any failure to deliver the goods within the expected time scale.

4: Goods

All furniture supplied by Built-In Solutions is made to your order to the specific design with the finish you have ordered. Accordingly these are goods made to your specification and the normal cancellation rights under the United Kingdoms Distance Selling Regulations do not apply. The Goods are manufactured or supplied in accordance with a description or specification provided by Built-In Solutions, you shall be responsible for ensuring the accuracy and adequacy of the description or specification, and for giving Built-In Solutions all necessary information relating to the Goods within a sufficient time to enable Built-In Solutions to perform the contract in accordance with its terms. We reserve the right to cancel the contract between us if we are unable to source the materials to make your order within a reasonable time or we do not deliver to your area. We will not be obliged to offer any compensation for disappointment suffered. If several furniture items have been ordered, a balancing payment will be required on completion of each furniture item, all items are treated as separate orders.

5. Tolerances

Our furniture is handmade, every piece in our range is a balance between cost and quality. We concentrate our efforts on professionally designing your furniture to look good in the space and look great from ‘Ordinary day to day viewing angles’, we make any piece look great, whilst supplying you with actual bespoke made furniture, rather then standard sized units bolted together from the likes of the big furniture companies and then subsequently misleading you and calling it ‘bespoke furniture’. We allow for various tolerances to all final supplied measurements. Variations in colour tone, between paint batches, colour variation in any items replaced or repainted, between supplier materials and grain configuration are to be expected. Depending on the type of lights that you have or the amount of natural daylight in the room, this can become more visible, these are not considered defects. Small blemishes and imperfections, disparities highlighted by light reflection from a direct light source, residue from cleaning products, and any disparity that is out of direct line of vision or not visible under ‘ordinary conditions’, are not considered defects. The tolerance for our Furniture range: Midrange Furniture: up to 7% tolerance and not visible under ‘ordinary conditions’ at a distance of around 2.0m. Our Midrange Plus Range: less than 5% tolerance and not visible under ‘ordinary conditions’ at around a distance of 1.5m. Our High End Range: within a few millimetres tolerance, and no visible disparities throughout. We will be happy to visit any issue via a report from a Professional independent furniture assessor provided at your expense.

6: Liability

We will not be liable to you for any loss of profits, administrative inconvenience, disappointment, indirect or consequential loss or damage arising out of any problem in relation to the goods. We shall have no liability to pay any money to you by way of compensation. Making good after other trades is not the responsibility of Built-In Solutions. All or any works by other trades must be completed prior to our fitting date. Any client induced delays will be charged at £200.00 + VAT per hour in hour segments. You must inform us of any Party Wall agreements, any fixtures and fitting that are present or embedded pipes or cables that do not conform to building regulations, failure to disclose and by letting us proceed with fitting of your furniture absolves us of any liability as detailed in this paragraph. All furniture is fitted to ‘best fit’ within the space provided. it is clients responsibility to make sure that the details and specifications are correct on the quotations and meet your requirements.

7: Fitting of your furniture

7a: Access & Space to work within: We require a clear space to work safely in. All items including lamp shades / low hanging light fittings, hanging picture frames, Curtains, Tables, Chairs etc must be removed prior to our arrival. Preferability, we request the room to be completely empty, however we understand that this may not be convenient, therefore we require at minimum 3 meters + the depth of the furniture of free space directly in front of the space the furniture is to be installed in, please cover all remaining items in the the room with dust sheets. If the room is smaller then our minimum requirements, the room must be completely emptied of all contents. We require all access corridors, and passageways to be completely clear from all obstacles and removal of all hanging items from walls. Doors must allow a minimum opening angle of 90 degrees. Brand new hard floors (Wood or easily scratched flooring is prone to any scuff or minor scratch looking amplified), or any other item that may require extra protection, adequate protection must be provided and implemented by the client, we will not be liable for any scratches or damage occurred if adequate protection has not been implemented. Any requirement by Built in Solutions to move items to create our minimum required space will be charged at £200 +VAT in per hour segments. We will not be liable for any damages that occur to your items or your home if we are required to move your items or when our minimum spacing requirements have not been provided. We will not be liable for any damages that may occur to your parked vehicles if they have not been moved to a safe distance that allows us to safely move large furniture items from our vehicle to your property. We understand that it may be difficult to move some large items or our minimum space can not be provided for various reasons, in these cases please contact us so we can agree on a solution. We will be happy to help move limited bulky items at no cost if this has been pre-arranged with us, however we will not be liable for any damage that may occur when moving these items. We are not permitted to remove our footwear due to H&S, however these will be in a clean state.

7b: For installation and safety purposes there may be a join in any material over 1,500mm.

7b: Carpets: Your furniture must be installed upon a solid base to prevent sagging. We will roll back or completely remove your carpet.  Carpet re-instalment is not the responsibility of Built in Solutions. Expect to pay a local carpet fitter between £50 – £100.  Instructing us to install on top of any flooring that is not a hard surface absolves us of any issue arising from sagging.

7c: To fit your furniture to a ‘tight fit’, scuffing or minor incidental damage may occur on any adjacent wall or ceiling surface is possible, and an acceptable part of fitting your furniture. You are advised not to decorate rooms prior to installation to avoid minor incidental damage caused during installation. You absolve us from all minor damage that may occur during the fitting process.

7d: Unable to fit your furniture : If we are unable to fit your furniture for any reason due to error by client or the client has not provided adequate space, or any other stipulation in section 6 will be subject to a £500.00 +VAT re-scheduling fee.

7e: Cancellation of scheduled fitting: We require minimum 2 working days notice of cancellation of a scheduled fitting date. If your cancellation falls within 2 working days of fitting it will be subject to a £500.00 +VAT re-scheduling fee.

8: Remedial Work

On the rare occasion that we may have conduct remedial work, this will be conducted within standard business hours of 9am to 6pm weekdays only.

AS A CONSUMER YOU HAVE STATUTORY PROTECTION REGARDING FAULTY OR MISDESCRIBED GOODS OR INADEQUATE SERVICES SUCH AS INSTALLATION. THESE TERMS DO NOT AFFECT THOSE RIGHTS.
